Without limiting the foregoing, the Services are not permitted to be used by minors (which means, in most jurisdictions, those under the age of 18) or temporarily or indefinitely suspended. Your use of the PuneetGems.com website represents and warrants that you have the right, authority, and capacity to enter into this Agreement and to abide by all the terms and conditions of this Agreement.

Non-Commercial Use

Unless registered and accepted as a PuneetGems.com "Affiliate," the PuneetGems.com website is for the personal use of individuals or members of the PuneetGems organization and cannot be used in connection with any commercial ventures. Links to other websites are part of the commercial endeavors. Whether these links are considered to be competitive with PuneetGems.com or otherwise unlawful and/or unauthorized uses of the website, such as framing or linking to the website without permission, will be investigated, and appropriate legal action, including but not limited to civil, criminal, and injunctive redress, will be taken.

PuneetGems.com has the right to collect any profit, revenue, benefit, etc. that you have earned, received, anticipated, or will get from your unlawful use of this website, along with a penalty equal to 50% of that profit, revenue, or benefit, from you, your successors, heirs, assigns, etc.

 Term

During your use of the Website, this Agreement will continue to be fully enforceable. You won't get a refund for any unused subscription costs if PuneetGems cancels your service due to your violation of this agreement. PuneetGems will have the final say over all matters pertaining to account termination. It is neither necessary nor permitted for PuneetGems.com to provide an explanation for why your account was terminated. Any clause that by its very nature can endure the termination of this agreement will be presumed to do so.

 Right to form Consortium/Associates

PuneetGems may, with or without informing you, outsource any portion of its services to any qualified individual or group.

 Proprietary Rights

• The Company holds all proprietary rights to the PuneetGems.com website and its products/services. The Website contains the Company's and its licensors' copyrighted materials, trademarks, and other proprietary information. Except for content in the public domain or for which you have received permission, you are not permitted to copy, edit, publish, transmit, distribute, perform, display, or sell any proprietary information. Any such conduct or attempted act on your part shall constitute a breach of this Agreement, and PuneetGems.com has the right to immediately cancel your membership without reimbursement of any unused Subscription costs.

 

• Content available on the website, but not directly provided by us, is the responsibility of the author and should not be relied upon. Such authors are entirely responsible for their material. The Company does not guarantee the accuracy, completeness, or usefulness of any information on the Service, nor does it adopt, endorse, or accept responsibility for the accuracy or reliability of any opinion, advice, or statement made by any person appearing on the Website. The Company or its affiliates will not be liable for any loss or damage arising from your reliance on information or other content posted on the Website or communicated to or by any Members. Any advice, opinions, or other information or content provided directly by us through the Advice Section, User Forum, or Community Forum should not necessarily be relied upon. We urge that you seek advice, options, or information from a trained specialist. Under no circumstances will PuneetGems.com or its affiliates be responsible for any loss or damage resulting from your reliance on information or other content posted on the Website or transmitted to or by any Members.

Obligations of the User

You are entirely responsible for the content you post on the Website, provide to Company personnel/affiliates, or share with other members. You will not post or transmit any defamatory, inaccurate, abusive, obscene, profane, offensive, sexually oriented, threatening, harassing, racially offensive, or illegal material, or any material that infringes or violates another party's rights. You will not give incorrect, misleading, or fraudulent information to the Company or another Member.

 • If any information submitted to the Company, its affiliates, personnel, or another Member becomes erroneous, deceptive, or untrue, you must quickly notify the Company of the change. PuneetGems.com retains the right to check the veracity of any Content uploaded on the Site. In exercising this right, the Company may request that you produce any documentary or other form of evidence supporting the Content you publish on the Site. If you fail to provide such evidence, the Company may, in its sole discretion, cancel your Membership without reimbursement.

• The Company reserves the right to review and delete any content, messages, photos, or profiles (collectively, "Content") deemed offensive, illegal, or threatening to the Company, its affiliates, personnel, or Members. 

 By posting Content to the Company's public areas, you grant the Company, its affiliates, licensees, and successors an irrevocable, perpetual, non-exclusive, fully paid, worldwide license to use, copy, perform, display, reproduce, adapt, modify, and distribute such information and content, as well as to prepare derivative works or incorporate into other works. You additionally represent and warrant that the Company's use of your material will not infringe or violate the rights of any third parties.

The Company maintains the right, in its sole discretion, to investigate and take necessary legal action against anyone who breaches this clause, including but not limited to deleting the offending communication from the Service and terminating such violators' membership. ·      Engages in commercial activities.

·      You must follow all relevant laws and regulations when using the Service and posting content.

·      You may not transmit any chain letters or junk emails to other Members. You warrant that it shall be a violation of these terms and conditions to use any information obtained from the website in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any Member without their prior explicit consent.

·      All information you include in your Member profile must be accurate, current, and complete.

Prohibited Activities

The Company reserves the right to investigate and terminate your membership if you misuse the service, proprietary information, or engage in inappropriate, unlawful, or illegal behavior. The following activities are strictly prohibited:

By using the site, you consent to receive communications via SMS, calls, or messages from the Company or authorized third parties—even if your number is on the Do Not Call list.
